Mag. Dr. Markus Albrecht

Markus Albrecht studied in Innsbruck and Paris, obtained his doctorate in copyright law in Innsbruck in 2014 and was previously a research assistant at the University of Innsbruck — a background that still shows in his advisory style today: he argues precisely, knows the literature and the Austrian Supreme Court (OGH) case law, without losing sight of the commercial perspective.

He has been with Tonninger Schermaier & Partner since 2014 — first as a trainee attorney, from 2017 as an attorney and from 2026 as a partner. In that time he has established himself as the firm's second pillar in IP. He is the author of §§ 66–72 of the Austrian Copyright Act (UrhG) in the Manz comprehensive commentary urheber.recht (3rd ed. 2023) and author of § 53 of the Trademark Act (MSchG) in the forthcoming 4th edition of the Manz commentary marken.schutz; alongside that, he publishes regularly on trademark, copyright and unfair-competition matters. Since autumn 2025 he has also been a part-time lecturer at the University of Applied Sciences BFI Vienna, teaching IT law.

On a mandate, Markus Albrecht consistently places the client's commercial concerns at the centre. Depending on the objective, pursuing legal positions “at any cost” — entirely detached from the associated expense — is rarely in the client's interest. He is clear in his assessments and lays out possible courses of action together with the expected costs up front.
